New anti-corruption law and governors under fire

The law on the register of corrupt persons was signed: the persons on the register cannot enter the state job. Farmers are again under reproach: the governor of one district received a fine, the other is under investigation. Regional governors are also criticized: one is accused of “hanging” on students, the other on teachers.

Some news about the life of Uzbekistan for the past week – in the Kun.uz digest.

It was suggested that banks automatically transfer information to the tax authority

206 million soums. If people transfer more than this amount of money per month to your card, you may have to be prepared for questions from the tax authorities. Tax Committee for public discussion of the next draft document on monitoring card-to-card transfers put.

According to the project, banks are proposed to automatically report this to the tax authority if funds equal to 500 times BHM, i.e. 206 million soums, are received on the bank card of an individual from other individuals within a month. In this case, when calculating the total amount of P2P-revenues, transfers from close relatives are not taken into account.

The tax committee has been trying for several years to control the money transfers of individuals on suspicion of secret business activities. Before that, at least three similar attempts observed in different years failed due to criticisms related to bank secrecy and opposition from the Senate and the Central Bank. The last time it was added to a decree in 2023 without public discussion and legal expertise the norm It was abolished after the renewal of the constitution.

206 million soums per month seems to be a high enough limit, but the main issue is that the mechanism is being created. Moreover, there is no guarantee that the fixed amount of BHM 500 will not be reduced later. In addition, this latest project is also distinguished by the fact that it has a much wider scope than the previous ones. Because now we are talking about bank secrets not only of individuals, but also of legal entities.

The draft decision envisages the transfer of information by banks to the tax authority about the large number of financial transactions of legal entities and individual entrepreneurs. In addition, it is suggested that the information about all receipts to their account in cash and through payment terminals should be collected at the discretion of the Tax Committee.

The Central Bank has not yet responded to the draft document. The public discussion will continue until July 8 on the website regulation.adliya.uz.

The mayor who insulted the farmers got a lot of money

The mayor swears at farmers, his audio is broadcast, the public says that farmers should be saved from the tyranny of the mayor, the requirements of decrees and laws are mentioned, “what if it were the other way around, what would happen if the farmer cursed the mayor?” the questions are prominent… In the end, the mayor’s office will be punished, and the issue will be put to a logical end.

This scenario, which has become a classic, was performed this time by the mayor of Muzrabot district of Surkhandarya. Last week, Abdulla Mamatkulov gathered the farmers who were not fulfilling the plan to hand over grain to the state in his room and scolded them one by one. threatened was On June 23, the Anti-Corruption Agency announced that Mamatkulov was given a fine informed.

The mayor interjected: “Why should I listen to you?” means that this is not just a district-level issue. Nevertheless, the question of who is pressing from above remained as open as ever. Let us remind you that the plan to sell grain to the state will be completely canceled starting from 2021. was said.

Halimjon Umarov from Kuva district of Fergana region is another mayor whose audio has been circulated throughout the week it is being said. In the audio, a farmer can be heard being insulted several times and told to take away his land. The administration of Fergana region informed that a service inspection will be conducted in connection with the situation.

Governors and the field of education

Since the streets are neglected in Samarkand, teachers may come and go again. Yesterday, regional governor Adiz Boboyev walked the streets of Samarkand turning aroundsaw the problems with his own eyes and gave a dashnom to those in charge. Soon, he held a meeting with rectors of higher education institutions and asked professors and students to take responsibility for keeping the streets clean. ordered:

“We will give one, two, three streets (depending on the kilometer, size, size, field) to every educational institution. This street will belong to such and such an institute. (…) Every morning one teacher walks around that street. He walks – it is also beneficial for health. Come on, how clean (the street) is, what are people struggling with, where are the sidewalks broken, where are the plants? it’s drying up, which plant isn’t thriving, which plant is diseased, or somewhere, the irrigation system doesn’t work.

According to Adiz Boboyev, teachers of the university should identify the problems in the street assigned to them and inform the improvement service about it. However, assigning tasks to pedagogues outside of their professional activities is prohibited by law. After the situation caused widespread discussion, the Labor Inspectorate issued a warning to Boboyev: “If you implement this idea, you will be punished.” sent.

Shuhrat Abdurahmanov is another governor of the region who has become a target of criticism in recent days. Under his leadership, 20,000 people were mobilized to enter the “Andijan Polka” into the Guinness Book of Records, and an event was held in the central stadium of the region where so many people danced at the same time. Naturally, it is impossible to gather a record number of people without involving the education sector. It happened in practice and this is a tragedy led by.

A group of students of the 14th school in Asaka district got into a car accident while returning from the event in a Damas car. As a result of a collision with a “ZIL” truck, students were admitted to the intensive care unit, one of them died despite the medical assistance provided. The regional school of education blames the children themselves and says that a bus was reserved for them, but the students arbitrarily went to Damas. The registry of corrupt persons will be activated

Finally, in Uzbekistan, an official list of corrupt persons will be drawn up, and their return to public service will be restricted it has been. The reason we are saying this is that such a task is in the presidential decree of June 2021 defined was That is, it took exactly 5 years to complete the task. In the meantime, for example, in 2023 alone, 566 corrupt people will re-enter the public service and commit corruption again. managed to. The long-awaited law should put an end to these situations.

According to the law signed on June 22 and coming into force on June 23, an electronic register of persons who have committed crimes related to corruption will be created. Their name is from the moment the court verdict entered into legal force, until term of conviction will remain in the register until it passes. Persons in the register are not accepted for public service, are not awarded with state awards; Companies whose share is more than 50 percent cannot participate in public procurement and public-private partnership contracts. They retain the right to work in state-owned companies and state-owned educational institutions, but cannot hold leadership positions in these organizations.

It is noteworthy that the presidential decree 5 years ago stipulated that the register of corrupt persons should be open to the public. But in the law adopted yesterday, the norm of the registry being open was not clearly established. “Receiving information from the electronic register is carried out in accordance with the procedure established by the law,” it is only said. Of course, from the legal point of view, the presidential decree is also part of the legislation, so the registry must be open.

“Sits” until the end, receiving a large bribe

Another important aspect of the law is related to the procedure for parole for bribe takers. It is known that most criminals have the right to apply for early parole after serving one-third of their sentence, if they do not commit serious violations during this period. With the law of June 22, the circle of persons with such right became narrow.

Now, people who have received large sums of bribes, repeated bribes, or those who have received bribes while being dangerous recidivists will not be released on parole. “A large amount” means 500 times the BHM, that is, 206 million soums today. Therefore, from now on, the persons who received bribes in the amount of more than 206 million soums or approximately 17 thousand dollars will have to complete the term written in the court verdict. Of course, if he is not pardoned after “sitting” for at least five years.

It should be noted that the rule “prohibition of early parole” applies not only to persons who have received bribes, but also to persons who have given bribes in large amounts or repeatedly, and who have acted as mediators in the transaction of bribes. At the same time, this ban does not apply to most other corruption crimes that are not related to bribery.

Another innovation in the law is related to the crimes of misappropriation, distribution and fraud. Now, persons who have committed these crimes cannot be released on parole without full compensation for the damage caused. In this way, the cases of corrupt people who “eaten up” the state property and fraudsters who defrauded hundreds of people were imprisoned for a year and a half and were released soon after. Because now such persons will have to compensate the state or the victims for the damages they have caused to the last penny in order to be released early.

Meanwhile, another privilege was reserved for them. According to it, those who have committed the crime of embezzlement, embezzlement and fraud will not be subject to imprisonment or restriction of freedom if they compensate for the damage during the investigation or trial.

    What else happened this week?

A presidential decree was signed on increasing salaries and pensions. According to it, from July 1, 2026, pensions and allowances will be 7 percent will rise. In particular, the minimum age pension amounts to 983,000 soums per month. Starting from September 1, salaries and stipends in budget organizations will also increase by 7%. Also, from September 1, the base calculation amount used for calculating fines and other payments will increase by 6.8% and will be equal to 440,000 soums.

Uzbekistan and Kyrgyzstan exchanged border areas. To the press service of the Kyrgyz president according tothe villages of Chongara and Tosh-Tobo, which were previously part of Uzbekistan, were transferred to Kyrgyzstan. About 2,500 people live in these villages, and most of them are said to be ethnic Kyrgyz. In turn, the Kyrgyz side is giving Uzbekistan an equal amount of land plots from the border area. It is not clear which regions are meant. There has been no official information on this from Uzbekistan yet.

The activity of 464 gas stations across the republic was temporarily suspended. This information is available in many outlets from explosions later cited in the government decision. According to the decision, 46,700 violations and deficiencies were detected at gas stations, half of which are related to violations of industrial and technical safety requirements. Phased relocation of fuel and gas filling stations deemed to be potentially dangerous in terms of location to safe areas is expected.
